(K1 Visa, K3 Visas - Fiancé and Fiancée
or Spouse of U.S. Citizen)
K-1
visa (nonimmigrant visa category):
The K1
visa category permits the fiancé(e) of a U.S. citizen
petitioner to enter the United States for a 90-day period to marry the
petitioner and apply for permanent residence. K1 visa processing may take
longer than processing for other nonimmigrant visas because it requires the
submission of comprehensive biographical and admissibility data twice - once
for entry into the United States, and the second time for the adjustment of
status application. A K1 visa petition must show the following:

The U.S. citizen and fiancé(e) must have previously met within two years
of the date of filing the petition, unless a waiver is granted;

There is a bona fide intention to marry; and
-
The U.S. citizen and fiancé(e) must be legally able and willing to
conclude a valid marriage in the United States within 90 days after entry
into the
United States

States. A K3 visa may be issued to a foreign national who has concluded
with a U.S. citizen once an immediate relative petition has been filed and
the K3 petition approved by the United States Citizenship and Immigration
Services (USCIS).
